RETURNS AND REFUNDS POLICY

Ginga Toys Ltd. (“us”, “we”, or “our”) operates the https://gingatoys.com website (the “Service”). This page informs you of our policies regarding returns, exchanges, and refunds.

Right to Cancel

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right to cancel, you must inform us by contacting us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than –
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right to cancel does not apply to the following kind of contracts:
– Contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalized.
– Contracts for the supply of goods which are liable to deteriorate or expire rapidly.
– Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
– Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.
– Contracts for the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery.
– Contracts for the supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications.

Returns within 14 days – Unwanted Goods

You have the legal right to cancel your order within 14 days of receipt of the goods for unwanted goods. In this case, any sum debited from your credit or debit card will be re-credited to your account as soon as possible and in any event within 10 working days after receiving your item back in our warehouse. If you want to return your order, you will need to follow the procedure set out below, in the general returns policy, within the 14 days period.

Returns within 30 days – Faulty/Damaged Goods

You have the legal right to cancel your order within 14  days of receipt of the goods for faulty/damaged goods. In this case, any sum debited from your credit or debit card will be re-credited to your account as soon as possible and in any event within 10 working days after receiving your item back in our warehouse. If you want to return your order, you will need to follow the procedure set out below, in the general returns policy, within the 14 days period.

General returns policy

We will offer you a refund provided that the products are returned complete, in perfect condition, unused, fully labeled and with the original packaging. We will not accept returns for any non-faulty items that have been worn and tags removed. To exchange a product please follow the returns procedure below requesting an exchange. Please note that you have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, your entitlement to a refund may be affected. We request that you do not remove tags or plastics until you are completely satisfied that the items will not be subject to return within any of the allotted timeframes above. We also request that items are returned with their original packaging. Where items are faulty and a replacement is not available please let us know and we will find a solution. For all returns, except where the item is faulty, you will be required to arrange and pay for the return of the products to us.

Please note that it’s not an obligation to follow the “General returns policy” to effectively exercise the legal right to cancel.

Returns after 14 days – Faulty/Damaged Goods

Returns received outside the above time frames will not be accepted.

The preferred process for returning goods

All items intended for return or exchange must have a Goods Return Number (GRN). GRN numbers must be obtained within 10 working days of receipt of delivery by emailing us and asking for a return. We will then reply with a GRN number. Once you have received this, please take care to follow the instructions emailed to you. You cannot return goods without this number. Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EC). It is the customer’s responsibility to retain copies of all tracking information and to ensure that the returned goods arrive at us within the above-stated timeframe. Please note that we do not accept liability for returned goods. When returning items you are strongly recommended to obtain proof of posting or the relevant couriers’ airway bills and documentation. We cannot accept responsibility for parcels lost in transit and you are advised to arrange your own insurance. We will only refund or provide an exchange for the costs of postage/transport where the item returned is faulty.

Please note that it’s not an obligation to follow the “Process for returning goods” to effectively exercise the legal right to cancel.

Pre-orders have specific Terms and Conditions regarding refunds and cancelations. Please check all the information here. Once you receive your Pre-Ordered item you can still exercise your legal right to cancel.
